Tutoring Client Agreement

1. Parties to This Agreement

This agreement is between [Your Name], trading as [Business Name] (the "Tutor"), and the client named below (the "Client" or, for under-18 students, the parent or guardian acting on their behalf).

This agreement takes effect on the date signed below and governs all tutoring sessions provided by the Tutor to the Client.

2. Services

The Tutor agrees to provide private tutoring in the subject(s) agreed between the parties. Sessions will be delivered as follows:

Session times will be agreed by mutual arrangement and confirmed in writing (email or message) at least [24 / 48] hours in advance.

3. Fees and Payment

The current session rate is [£XX per hour / per session]. Fees are reviewed annually and the Tutor will give at least 4 weeks' written notice of any increase.

Payment is due:

Invoices not paid within 14 days may attract a late payment fee of [£5 / 2%] per week. The Tutor reserves the right to suspend sessions while fees remain outstanding.

4. Cancellations and Rescheduling

The Tutor operates the following cancellation policy:

If the Tutor needs to cancel a session, the Client will be offered a full refund or a replacement session at a mutually convenient time. The Tutor will not charge for sessions cancelled on their own initiative.

Emergency cancellations (documented illness, bereavement, or similar) may be waived at the Tutor's discretion.

5. Safeguarding (Under-18 Students)

Where the student is under 18 years of age, a parent or guardian must sign this agreement. Online sessions with under-18 students are conducted with the parent/guardian's knowledge. The Tutor holds a current enhanced DBS check (disclosure number: [DBS Number — or "available on request"]) and follows local safeguarding guidelines.

Parents/guardians are welcome to be present during in-person sessions. For online sessions, the Tutor asks that a parent/guardian is in the building during the session. Session recordings are not made without prior written consent.

6. UK GDPR and Data Protection

The Tutor processes personal data as a data controller under the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018. The data collected (name, contact details, education information) is used solely to provide tutoring services and to fulfil legal obligations. It is not shared with third parties except as required by law.

Data is retained for a period of [6 years / 3 years] after the last session, then securely deleted. A full Privacy Notice is provided separately.

7. Intellectual Property

Any materials created by the Tutor (worksheets, lesson plans, resources) remain the intellectual property of the Tutor. The Client may use materials for personal study but may not reproduce, share, or sell them without written consent.

8. Liability

The Tutor endeavours to provide high-quality tuition but cannot guarantee specific exam results or grade outcomes. The Tutor's liability in connection with this agreement is limited to the total fees paid in the three months preceding any claim.

For in-person sessions at the Client's premises, the Client is responsible for ensuring a safe environment for the Tutor.

9. Termination

Either party may terminate this agreement by giving [2 weeks / 4 weeks] written notice. The Tutor may terminate immediately if fees remain unpaid for more than 30 days, or if the Client (or student) engages in conduct that the Tutor reasonably considers inappropriate or unsafe.

All outstanding fees remain due on termination.

10. Governing Law

This agreement is governed by the law of England and Wales. Any disputes will be resolved in the courts of England and Wales.
